A U.S. federal judge has struck down the Trump administration’s suspension of immigrant-visa processing for nationals of 75 countries, including Nigeria, dealing a major legal blow to the administration’s immigration crackdown. U.S. District Judge Jeannette Vargas of the Southern District of New York ruled on August 21 that the policy was “contrary to law” and exceeded Secretary of State Marco Rubio’s statutory authority.

The policy, introduced in January, effectively halted the processing of immigrant visas for citizens of the affected countries on the administration’s argument that they were at high risk of becoming dependent on public assistance in the United States. Judge Vargas found that imposing a blanket restriction based on nationality unlawfully displaced the individual assessment that immigration law requires consular officers to make.

For Nigerians seeking to immigrate to the United States, the ruling offers significant relief. Visa refusals based solely on the now-invalidated policy have been set aside and are to be returned for further consideration by consular officers. However, the ruling does not automatically grant visas to affected applicants; individual eligibility requirements still apply.

The Trump administration can still appeal the judgment, meaning the legal battle may not yet be over. Nevertheless, the decision represents a significant judicial check on the administration’s immigration policy and reinforces the principle that immigration restrictions must operate within the authority granted by Congress.
